General Terms and Conditions
Ladanyi Flower Design (Sole Proprietorship)
In the absence of any different agreement, the General Terms and Conditions apply as the basic rules.
1. Scope These general terms and conditions (hereinafter “General Terms and Conditions”) apply to all business relationships between the company and the customer (including consulting and other services) in the version valid at the time of the order. Different conditions are only valid if confirmed in writing.
2. Flower Information Flowers are seasonal products. Therefore, the full range is not always available. Accordingly, the bouquets shown are adapted to the respective season. We cannot always guarantee that individual flowers will always be available, especially for short-term orders. Therefore, a bouquet may look slightly different in person than in the picture. However, each bouquet is a unique piece made fresh to order, and its shape and colors are as close as possible to the picture.
3. Prices Price adjustments for products and services can be made at any time, as flower prices are naturally subject to seasonal and regional fluctuations. Only the prices confirmed in the order confirmation or displayed in the store are valid. If the customer modifies or cancels the order, we may charge a fee.
4. VAT The prices we provide include VAT.
5. Delivery Conditions
5.1 Delivery Date Delivery usually takes place on the desired day. Exception: Sundays and public holidays. Due to legal regulations, delivery is not possible on Sundays and public holidays.
5.2 Flower Delivery to the Recipient If the recipient cannot be found at the delivery address, the flower sender will attempt to deliver the flower order to a third party who seems suitable for passing it on to the recipient (e.g., neighbor, receptionist, funeral home, etc.). If this is not possible, the flowers will be taken back, and a notification card will be left.
5.3 Deliveries for Special Occasions and Events For deliveries on special occasions, this is done according to the order confirmation at the time. In the absence of a different agreement, the service of the store includes the removal and disposal of decorations if the customer does not wish to take them with them.
5.4 Accuracy of Delivery Address Please ensure that the delivery address and telephone number provided to us are correct and complete for your own benefit. We cannot be held responsible for delays or failures due to incorrect or incomplete addresses. If the product needs to be redelivered, a delivery fee will be charged.
5.5 Hospital and Hotel Deliveries For hospital deliveries, if possible, the ward and room number must be provided. For hotel deliveries, please provide the room number and the name under which the recipient is registered at the hotel (group, couple, etc.).
6. Payments
6.1 Payment by Invoice Invoice payments must be made within ten (10) days net from the invoice date. The Company reserves the right to carry out delivery against cash on delivery or advance payment for new customers or justified individual cases.
6.2 Late Payment In case of late payment or deferral, the company is entitled to charge statutory interest of at least 5% per annum, as well as a reminder fee of CHF 30 when necessary; We reserve the right to claim further costs. Depending on creditworthiness, the subject matter of the contract, and the volume of the contract, the company reserves the right to request a different method of payment or additional security for the advance payment. For larger orders of CHF 2000 or more, the store may require at least a 50% deposit.
7. Procurement Problems In the event of unforeseen unavailability of the ordered goods, the store reserves the right to deliver equivalent goods.
8. Warranty The store guarantees a minimum shelf life of 4 days for fresh cut flowers, provided that the customer provides proper care for the cut flowers and ensures a sufficient amount of water. Liability for other deliveries is excluded.
9. Data Protection Protecting your personal data is an absolute priority for Ladanyi Flower Design. We strive to guarantee the highest level of data protection and security. We use your personal data solely for processing orders. We handle your email address and personal data confidentially and do not disclose them to third parties. In our online store, order processing is done using an order form. The provided data is used for delivery, order confirmation, and, if necessary, to answer your questions. However, we do not intend to trade them. Credit card data is not saved. At the end of the ordering process, this data is directly forwarded to the credit card companies and processed through encrypted connections.
10. Holidays Our flower shop is closed on the following holidays: Good Friday, Easter Monday, Ascension Day, Corpus Christi, Whit Monday, Swiss National Day, Assumption Day, All Saints’ Day, Immaculate Conception, Christmas: December 25/26, New Year: January 1/2.
